Right of Way Permit for Beavercreek Township

Responsibility
No openings shall be made or work done on, across, along, or adjacent to the right-of-way of any Township Roadway without a written permit from the Beavercreek Township Board of Trustees.
Said permit shall be subject to the following regulations, except in specific cases when the Township Trustees may authorize a variance from these regulations.

Regulation
More than one application may be included on a single permit form if all are part of the same project. An applicant shall pay one permit fee for the application and a deposit for multiple openings according to the schedule in the section on "Financial Obligations."

The Beavercreek Township Trustees or their representative is charged with the administration and enforcement of these regulations and provisions. Representatives shall receive written applications, issue permits, and examine premises for which such permits have been requested or issue and enforce compliance with provisions of these regulations.

The acceptance of a permit or doing of any work shall constitute an agreement by Party or Parties to whom the permit is granted to comply with all of the conditions and restrictions printed or written herein.

The permit may at any time be revoked or annulled by the Beavercreek Township Board of Trustees for nonperformance of or noncompliance with any of the conditions, restrictions, and regulations hereof.

Any person or firm, corporation, or governmental agency that performs work for which a permit is required shall:

1. Maintain traffic at all times, unless permission is granted by the Township Trustees to close the road. If a road must be closed, the following steps shall be taken:
A. Applicant shall work with the Beavercreek Township Trustees or their representative to establish a detour route.
B. Applicant shall place all "Detour" and "Road Closed" signs in approved locations. All signs, barricades, traffic cones, and other traffic control devices necessary for safety shall be approved and comply with the "Ohio Manual of Uniform traffic Control Devices."
C. The applicant may request the Township to assign detour routes and install related traffic control devices; however, the applicant shall pay for the cost of the work done by Township forces.
2. Shall keep the disturbance of road surface and shoulder to a minimum. Backfill shall be compacted #304 aggregate minimum.
3. Shall place lights, signs, barricades, and if necessary, flaggers and watch- person on the job site for the protection of traffic at all times, day and night; during the time this work is being done and shall follow instructions given by the Beavercreek Township Board of Trustees or their representative as to handling traffic. If at any time the Township is required to place barricades, lights, and/or signs at the location stated on the application or related thereto, the applicant shall reimburse the Township for the costs involved.
4. Shall be the responsible for and shall save the Township harmless from any, and all claims for personal injuries and property damage, and shall defend any action that might be brought due to the work proposed in the application or carries out with the permit.
5. Shall follow all OSHA standards to complete the work.
6. Shall inform the Township that the person, firm, corporation, or governmental agency is covered by insurance that is currently in force and will remain in force during the performance of this work.
7. Any culvert pipe installed across, along, or adjacent to Township right-of-way shall be constructed of approved galvanized steel, aluminum, reinforced concrete, or double wall plastic unless otherwise specified by the Township. Culvert pipe shall be approved prior to installation.
8. Any culvert pipe installed across, along, or adjacent to the right-of-way shall be a minimum of 12 inches internal diameter, unless otherwise specified The Township or Greene County Engineer reserves the right to determine the size of the pipe installed.
9. All concrete driveways shall stop a minimum of Twenty-four (24) inches from the edge of the roadway, unless otherwise specified by the Township or Greene County Engineer.
10. All driveways shall be flush with the roadway pavement surface where the two areas meet. Crack between the pavement edge and the driveway shall be filled with approved crack fill.

Any person, firm, corporation, or governmental agency who performs work for which a permit is required by these regulations without first having secured such a permit, or fails to comply with the conditions under which the permit was obtained, thereby shall be deemed in violation of these regulations and subject to the penalties provided by law.

Failure to obtain a permit prior to starting work will result in the permit fee being increased from Ten Dollars to Twenty Dollars to cover additional costs incurred by the Township.
